General Conditions of Contract

Valid for all activities who are provided under the label of swissfreeride.ch.

Registration
Registration for a trip can be done by telephone, by written correspondence or via email. Once registration is complete the general conditions of contract automatically become part of the agreement between client and MRM Mountain Sports GmbH. Following registration the client will also receive a written confirmation and bill and the corresponding detail program, however please note that a detail program and bill will only be sent when a package arrangement is booked. Deadline for registration is always 30 days before the beginning of the desired package.

Payment
Payment for package offers must be recieved at least 14 days prior to the beginning of the trip. For private bookings the client will pay at the end of the trip.

Cancelation, trip abandon, charges for cancellation
Please note that a cancellation must be confirmed in writing.
If a participant cancels his booking the following charges will be applied:
For cancellations up to 30 days before trip begins, 50% of the full price will be charged.
For cancellations  less than 30 days before trip begins the full price will be charged.
We therefore recommend purchasing a cancellation insurance policy, such a purchase is the participant’s responsibility.

Cancellation or changes to program made on the part of the Organiser:
If the conditions (weather, snow, ability of participants or number of participants) make the completion of a given trip impossible for safety or other reasons, the organiser reserves the right to change the program or to move to a different location and in this case the added expenses would be the participants responsibility.  In the case of an insufficient number of participants the organiser reserves the right to cancel the scheduled trip. In this case the participant will be refunded the full price of the trip or the price will be increased with the agreement of all participants to cover the costs and let the trip take place. If expenses have been incurred up to the beginning of a cancelled trip the organizer reserves the right to declare these expenses non-refundable.

Insurance
The participant is responsible to purchase sufficient insurance or to assure himself that he is sufficiently covered for a trip to the backcountry. A complete and appropriate insurance including accident and sickness is the responsibility of the participant.

Exclusion of liability/ Assumption of Risk/
MRM Mountain Sports GmbH is just responsible for the organizing part of the the trip such as organize the Mountain Guide, hotels, huts, journeys.
The Mountain Guide who leads the trip is exclusively responsible for the savety of
his clients.
As certified Mountain guides they do their best to offer our participants the highest degree of safety and security which they estimate as possible in the backcountry. The dangers of the mountains and the backcountry with which they are confronted sometimes lead to unforeseeable circumstances and situations. They endeavour to use their complete experience to properly estimate and avoid potential dangers. By assuring this they keep the risk as low as possible. Through a booking the participant accepts the fact, that activities in the mountains are dangerous and a certain residual risk always exists. Through a booking the participant assumes full responsibility and denies his right to hold the organiser responsible for damage to body or material goods.

Jurisdiction
The exclusive court jurisdiction is in Teufen, Kanton of Appenzell Ausserrhoden, Switzerland. For any complaints, charges or suits against the organiser the only applicable law is Swiss Federal Law.
